Introduction
Fujikura Composite America, Inc. (“Fujikura Golf”, “we”, “our”, or “us”) respects your privacy and is committed to protecting your personal information. This Privacy Policy outlines how we collect, use, disclose, and safeguard your data when you visit or make a purchase from any website operated under https://fujikuragolf.com, or call or email us (the website and any phone calls or emails referred to collectively in this Privacy Policy as the “Site”). This Privacy Policy does not apply to any third parties or their websites, goods, or services, or any site displaying its own privacy policy, and we expressly disclaim any responsibility for any practices or procedures of those third parties. Without limiting the foregoing, this Privacy Policy does not apply to our Japanese parent, Fujikura Composites Inc., or its website (https://www.fujikurashaft.jp/).
We do not currently target our Site to individuals outside of the United States – such as to (without limitation) the European Economic Area, Switzerland, the United Kingdom, or Canada. Nor do we intend for our Site to be accessed by anyone outside of the United States. If that changes, we will update these terms to ensure we reflect any additional rights reserved under applicable laws. Those updates will be made available within this Privacy Policy, in accordance with applicable law.
The Site is hosted on servers in the United States. Any personal information you provide to us will therefore be processed and stored on servers in the United States, the laws of which may be deemed by other countries to have inadequate data protection. If you are located outside the United States, you consent and continue to consent to the processing and storage of such data in the United States and for evaluating whether the use of the Site is lawful where you reside.
In addition, our Site is not intended for children under 16 years of age and we do not knowingly collect personal information from children. If you are under 16, do not provide any information on this Site. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information.

1. Information We Collect
We may collect the following categories of personal information:
• Personal Identifiers: Name, email address, your website, company name, shipping address, phone number.
• Payment Information: Billing address, payment card details (processed securely via third-party processors).
• Commercial Information: Purchase history, product preferences.
• Device/Internet Activity: IP address, browser type, operating system, referring URLs, unique identifiers, and interactions with our Site.
• Geolocation Data: Based on IP address or shipping address.

2. How We Collect Information; Use of AI Chat Agent
We collect personal information in the following ways:
• When you sign up for our newsletter.
• When you fill out forms on our Site.
• When you place an order through our eCommerce platform (WooCommerce).
• When you call or email us.
• Through cookies and tracking tools (e.g., tools used by Google Analytics and third-party advertising services).
• From social networks when you use plug-ins or click “Like,” “Share,” or similar buttons to interact with content we have posted on platforms such as Instagram, Facebook, Twitter/X, and YouTube.
• When you use the AI chat agent on our Site (currently, the Lyro AI Agent powered by Tidio LLC) (https://www.tidio.com/).
You represent that all information you provide to us is accurate, complete, and current.
3. How We Use Your Information
We use your information to:
• Fulfill orders and provide customer support.
• Send marketing emails and promotional text messages (you may opt out at any time).
• Conduct Site analytics to improve our user experience.
• Send targeted advertisements for our products to you.
• Respond to inquiries and feedback, including queries sent through our AI chat agent.
• Support internal market research.
• Carry out our obligations and enforce our rights arising from any contracts entered into between us.
• Fulfill any other purpose disclosed by us when you provide the information.

4. How We Share Information
We may share non-personally identifiable information, such as aggregated and deidentified user statistics, without restriction. We may also share the information we have collected about you—including personal information—as disclosed at the time you provide such information and with the following:
• Payment processors for secure transaction processing.
• Shipping providers to fulfill and deliver your orders.
• Customer Relationship Management and email marketing platforms like Mailchimp for communication.
• Other third-party service providers acting on our behalf to fulfill orders, perform administrative tasks, improve Site performance, manage communications, engage in AI-supported chat features on the Site, and conduct research.
The foregoing parties are contractually obligated to protect your information and use it only for the purposes specified by Fujikura Golf. Without limiting the foregoing, our AI chat agent vendor does not use personal information to train its model: only aggregated and anonymized data is used for such purposes. We also may share your personal information in the following ways:
• Third Parties Designated By You. We may share your personal information with third parties where you have instructed us or provided your consent to do so.
• Promotions. We may offer promotions through the Site. By participating in a promotion, you agree to the terms, conditions, and/or official rules that govern that promotion, including terms related to the disclosure of your personal information.
• Administrative and Legal Reasons. We may also disclose personal information to enforce or apply our agreement(s) with you or if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on us; and (b) protect and defend our rights or property, other users of the Site, or the public.
• Business Transfer. We reserve the right to disclose and transfer all information related to the Site, including, without limitation, all personal information: (y) to a subsequent owner, co-owner, or operator of the Site; or (z) in connection with a merger, consolidation, reorganization, divestiture, restructuring, the sale of substantially all of our equity interests and/or assets, or other corporate change, including, without limitation, during the course of any due diligence process or during any bankruptcy, liquidation, or similar proceeding.
• Analytics and Targeted Advertising Vendors. We use third parties, including the following, to provide Site analytics and serve targeted advertisements to you:

o The Trade Desk, Inc. (https://www.thetradedesk.com/).
We do not share your personal information with third parties for third-party marketing purposes, or for any other purpose other than as described in this Privacy Policy. Notwithstanding the foregoing, we use Meta Ads, Google Analytics, and Google Ads, which are subject to those companies’ respective privacy policies – and may involve us sharing information collected via their cookies and other tracking technologies with those companies. We have not sold, and—except in connection with a business transfer (described above)—we will not sell your personal information. Notwithstanding the foregoing, the use of third-party vendors for analytics and targeted advertising has been interpreted as a “sale” and “sharing” by some privacy regulators. We are therefore disclosing that we may sell or share your personal information to analytics and targeted advertising providers, and are providing a webform on our Site where you may opt out of “sales” and “sharing” of your personal information.
5. Cookies and Tracking; Targeted Advertising
As disclosed in our Cookie Policy, we use cookies and other tracking technologies on the Site (collectively, “Cookies”). This includes Cookies necessary to ensure operation of the Site (e.g., logging in, adding items to your cart), Cookies to understand how users interact with the Site and measure the Site’s performance, Cookies to enhance functionality and performance, and allow personalization, and targeted-advertising cookies. These Cookies collect unique identifiers, including IP address, that constitute personal information. Regarding targeted advertisements, we use Meta Ads, Google Ads, and The Trade Desk to display advertisements across the internet. These ads might appear on Google search results pages, YouTube videos, Facebook and Instagram, through streaming services, and/or on websites that are part of the Google or Meta display network. The ads you see may be based on your previous interactions with our Site, your search history, or your interests, as inferred by Google and/or Meta. We also use Google Analytics. We also use Google Analytics to assist in gauging Site traffic patterns, daily visitor volume, and overall access patterns and visitor origination points. 6. Global Opt-Out Mechanism

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, plus a reasonable period to comply with legal obligations, resolve disputes, or enforce agreements.
We take steps to protect your information, including secure servers, SSL encryption, and access controls. However, no method of transmission over the Internet is 100% secure, so we cannot guarantee its absolute security.
8. Your Rights
The section below details how you may review, update, or delete certain personal information and exercise any additional rights you may have under applicable law when we are processing your personal information.
• Opting Out of Text Messages and Promotional Emails. You may opt out of receiving any text messages by replying “STOP.” You may opt out of marketing or promotional emails from us by (a) clicking the “Unsubscribe” (or similar) link in those emails or (b) emailing sales@fujikuragolf.com. Please keep in mind that you may still receive transactional and service-related emails from us, such as emails related to your purchases.
• Other Rights for Certain U.S. Residents. If you submit your request by email, please put “OPT-OUT REQUEST” in the subject line.
o Right to Opt Out of Profiling. As applicable, you have the right to opt out of certain automated profiling, particularly if the profiling is done in connection with access to critical goods or services (e.g., essential goods or services or employment).
o Right to Nondiscrimination. We will not discriminate against you for exercising your privacy rights. For example, unless permitted by law we will not: (a) deny you goods or services; (b) charge you different prices or rates for goods or services; (c) provide you a different level or quality of goods or services; (d) retaliate against you as an employee, applicant for employment, or independent contractor for exercising your privacy rights; or (e) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services, because you exercised a right under applicable privacy laws.
o Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to request certain disclosures regarding personal information sharing with affiliates and/or third parties for marketing purposes.
o Right to Appeal. If, after submitting a request under this section, you believe we have refused to act according to applicable law, you may appeal our action or inaction by using the following appeal process:
As indicated in the “Contact Us” section below, send us a notice with “Privacy Rights Appeal Notice” in the subject line (“Appeal Notice”) within 60 days of the earlier of either (a) our rejection of, or failure to fully comply with, your request or (b) if we have not responded to your request, when you initially submitted your request.
– The Appeal Notice must contain information sufficient for us to verify your state of residence, identity/authority to act on behalf of the consumer, and evaluate your appeal.
– We will either approve or deny your appeal within 45 days of your Appeal Notice, and will notify you in writing (which may be by email), of our decision and the reason(s) for our decision.
– If we deny your appeal, our notice may provide you with contact information for the attorney general in your jurisdiction so you may submit a complaint to them.
Depending on the law that applies where you live, you may have additional rights. Please note that, regardless of where you reside, we may be unable to change or delete personal information if we believe it would violate any law or legal requirement or cause the information to be incorrect.
